Model Release Clause
Client(s), for good and valuable consideration hereby irrevocably authorize Hearts on Fire to use photographs of the event date and all parties involved and authorize them and their assignees, licensees, legal representatives and transferees to use and publish (with or without Client's name) photographs, pictures, portraits, or images herein described in any and all forms of media and in all manners, including composite images, for the purposes of publicity, advertising, publishing (including publishing to internet websites), for any product or services, or other lawful uses as may be determined by Hearts on Fire. Client further waives any and all rights to review or approve any uses of the images, any written copy or finished product.
Client Rights
Regarding the images delivered, as digital files or otherwise, Client’s rights are limited to personal use. Photographs may not be sold or used in advertising unless otherwise specified by the Photographer.
Photographer Rights
It is understood that any and all images, whether proofs, digital files, final prints or sample prints, and all rights to them remain the property of the Photographer.
Description of Services
This agreement constitutes an order for wedding photography services. It is agreed to by both parties, Photographer(s) and Client(s). Client agrees to pay Total Amount by the Final Payment Due By date as defined above.
Exclusive Photographer
Hearts on Fire shall be the exclusive photographer obtained by the client for the purpose of photographing the wedding. Family and friends of the client shall be permitted to photograph the wedding as long as they do not interfere with the Photographer's duties. Hearts on Fire is not liable for missed or ruined shots due to interference or interruption from wedding guests.
Failure to Perform
If Hearts on Fire cannot perform this agreement due to fire, casualty, act of God, illness, or any other cause beyond the control of Photographer, Hearts on Fire shall return all monies paid, minus services already completed (ie: engagement session), and shall have no further liability with respect to this contract. This limitation of liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or memory card malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. In the event that Photographer fails to perform for any other reason, Photographer shall not be liable for any amount in excess of the value of Client’s package.
Final Images
Final images are individually edited at the full discretion of the Photographer. These images are used for online proofing, high-resolution files and albums. Client cannot alter images in any way. Photographer will edit photos for color correction, exposure, and basic retouches including blemishes and minor wardrobe malfunctions if feasibly possible. Extensive retouching at the request of the Client can be purchased at an additional fee of $15 per image. Under no circumstances will Photographer provide RAW, unedited images to the Client.
Permissions
All permits and permissions required for the Photographer to photograph the event, whether for location, personal release or any other cause, are the responsibility of the Client to obtain.
Reservation, Reservation Fee, & Cancellation
The Amount Due at Signing is a Reservation Fee. Upon receipt, the Photographer will reserve the date agreed upon for the event and will not make another reservation for the agreed upon date. For this reason, in the event that the Client cancels the event for any reason, all monies paid shall be retained by Hearts on Fire in order to offset the loss of business.
Transfer
This agreement cannot be transferred or assigned to any third party by either the Photographer or Client without the written consent of both Parties.
Execution
Clicking "AGREE" at the bottom of this agreement has the same effect as manually signing a paper original.
Entire Agreement
This is the entire agreement between Hearts on Fire and Client and supersedes all previous agreements. It cannot be altered without written consent of both Photographer and Client.
